Toney Kirk

Toney Kirk was born a slave. His master, a lawyer, left over 500 acres to him. Sixty-seven acres were not to be sold but kept to provide a home for his daughter, Parthenia and her children. Toney's master, being very religious, married his slaves and allowed no separations. Toney died January 14, 1895, leaving a $4,000 estate. His will, witnessed by James T. Kirk, was protested by his son, Buck. Buck claimed that Toney "was not competent to devise and bequest his estate."
